Welcome to DushiGo! These Terms and Conditions ("Terms") govern your use of the DushiGo website at https://dushigo.com ("Website") and the services provided by DushiGo ("we", "us", or "our"). By accessing our Website or using our services, you agree to comply with these Terms.

1. About DushiGo
DushiGo is an online platform that connects boaters with marina operators offering boat slips for short- and long-term rental. Our operators provide secure, managed berths and slips for boats and yachts in marinas across Europe.

2. Bookings and Payment
Booking Process: All bookings must be made through our Website. Users are required to create an account and provide accurate information.
Fees and Payment: Payment is processed upon booking through our third-party provider, Stripe. All fees, including applicable taxes, are displayed at checkout.
Payment Methods: All transactions occur through the Website. Operators are not permitted to accept direct payments. Additional charges may apply for late check-out or extended stays.
Confirmation: After payment, users receive a confirmation email with booking details. Booking payments are generally non-refundable, except as specified under our Cancellation and Refund Policy.

3. Operator Responsibilities
Slip Standards: Operators are responsible for providing safe, accessible, and well-maintained slips. They may verify users' boat registration and identity upon arrival and enforce marina rules.
Monitoring: Operators are expected to maintain a safe environment, including monitoring access to the marina and slips. Operators must promptly report issues to DushiGo.
Liability: Operators are responsible for the condition of the slip and marina facilities unless issues arise from force majeure events or actions by users that violate these Terms.

4. User Responsibilities
Account and Information: Users are responsible for the accuracy of the information provided during booking, safeguarding their accounts, and following operator instructions.
Identification: Users must comply with requests for valid identification and boat registration when required by the operator.
Timely Arrival and Departure: Users must arrive and depart at the scheduled times. Failure to do so may result in additional fees or cancellation of the booking.

5. Prohibited Activities
Users agree not to:
- Use slips for illegal or commercial activities not permitted by the marina
- Store hazardous materials or conduct repairs that violate marina rules
- Disturb other marina guests or violate local laws
Operators reserve the right to terminate bookings for violations without refund.

6. Cancellation and Refunds
Policy: Cancellations are allowed up until the designated check-in day. For cancellations:
- Before the check-in day, users may receive a 50% refund or a 100% credit toward a future booking.
- After the check-in day, cancellations are non-refundable.
Processing: Refunds are issued to the original payment method, typically processed within 5-10 business days.

7. Guarantee and Liability
Coverage: DushiGo is a booking platform and does not insure boats or personal property. Users are responsible for their own insurance. Operators are responsible for the condition of their slips and facilities.
Claim Process: Any claims or disputes must be reported within 72 hours of the end of the booking. DushiGo will mediate disputes but is not liable for damages or losses.

8. Limitation of Liability
Platform Role: DushiGo acts as an intermediary and is not liable for damages related to operator services, including but not limited to loss, damage, or theft of boats or property.
Liability Cap: Our liability is limited to the fees paid by the user for the booked slip.

9. Privacy and Data Protection
Data Collection: We collect and process personal data as necessary to manage bookings and improve services. Detailed information on data handling is available in our Privacy Policy.
User Rights: Users can request access to or deletion of their data under applicable data protection laws.

10. Terms Modifications
We may update these Terms occasionally. Updates will be posted on our Website, and significant changes may be communicated via email. Continued use of our Website after updates constitutes acceptance of the revised Terms.

11. Applicable Law and Disputes
Governing Law: These Terms are governed by the laws of France and the European Union.
Dispute Resolution: In the event of a dispute, users agree to resolve matters through mediation before pursuing legal action.
